Terms & Collection Agreement

By submitting an enquiry and ticking the authorisation box, the client appoints Smarter Dollars (Australia Finance Pty Ltd, ABN 41 622 645 783) to pursue recovery of the debt described, and warrants that it has full legal authority to give that instruction.

客户提交咨询并勾选授权确认后，即委托 Smarter Dollars（Australia Finance Pty Ltd，ABN 41 622 645 783）追收所述欠款，并保证其拥有作出该委托的完整合法权限。

We accept commercial (business-to-business) debts only. We do not collect consumer debts.

我们仅受理企业对企业的商业欠款，不承接个人消费类欠款。

Commission is charged only on amounts actually recovered, at the rate shown in the fee schedule applicable to the amount recovered and the age of the debt when it is handed to us. GST is payable in addition.

佣金仅按实际收回金额计收，费率依照收费标准中对应的回收金额及交付时账龄确定。佣金外另加 GST。

Recovered funds are paid directly into the client's own account. We invoice our commission after the client has been paid, with payment due within 7 days of our invoice.

回收款项直接支付至客户本人账户。客户收到款项后，我们再开具佣金发票，客户应于发票开具后 7 日内付款。

(a) Accurate information — the client must provide true, complete and current information about the debt, the debtor and the supporting evidence, and must promptly correct anything that changes.

（a）提供真实信息 — 客户须提供关于欠款、债务人及相关凭证的真实、完整、最新的信息，情况变化时应及时告知更正。

(b) Notify direct payments — if the debtor pays the client directly, in whole or in part, or provides goods, credits or any other value in settlement, the client must notify us in writing within 3 business days.

（b）直接付款须告知 — 若债务人直接向客户全额或部分付款，或以货物、抵扣或其他任何形式的对价清偿，客户须于 3 个工作日内书面告知我们。

(c) Payments during engagement are commissionable — any amount recovered from the debtor during the engagement, or within 90 days after it ends, is treated as recovered through our efforts and attracts our fee.

（c）委托期内回款计佣 — 在委托期内，或委托结束后 90 日内，自债务人处收到的任何款项，均视为经我方努力收回，应按约定计收佣金。

(d) Breach — if the client conceals a recovery, or settles behind our back to avoid the fee, the full commission on that amount becomes payable, together with reasonable costs of recovering that commission.

（d）违约 — 若客户隐瞒回款，或私下和解以规避佣金，则该笔金额的全额佣金立即到期应付，并另行承担我方追讨该佣金的合理费用。

The client must not instruct another agency or take legal action on the same debt during the engagement without telling us first.

委托期内，客户不得在未事先告知我们的情况下，就同一笔欠款另行委托其他机构或提起法律程序。

We contact debtors in English and Simplified Chinese as a neutral third party, and follow the ACCC / ASIC Debt collection guideline and the fair trading requirements of the relevant Australian state or territory. We are firm, but always within the law.

我们以中立第三方身份使用中英双语联系债务人，遵守 ACCC / ASIC《催收指引》及相关州或领地的公平交易规定。态度坚定，但始终依法行事。

We confirm with the client before escalating a matter towards legal proceedings. Legal costs, court fees and any agent or solicitor disbursements are the client's responsibility and are separate from our commission.

升级至法律程序前，我们会先与客户确认。诉讼费、法院费用及律师或代理支出由客户承担，与佣金分开计算。

We do not guarantee that any debt will be recovered, in whole or in part. Nothing on this site or in our communications is legal advice; the client should obtain independent legal advice where appropriate.

我们不保证任何欠款能够全部或部分收回。本网站及我方沟通内容均不构成法律意见，客户应在必要时自行寻求独立法律意见。

The client authorises us to use the debtor and debt information supplied for the purpose of collection. Personal information is handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

客户授权我们将所提供的债务人及欠款信息用于催收目的。个人信息将依照《1988年隐私法》（联邦）及澳大利亚隐私原则处理。

Either party may end the engagement in writing. Commission already earned, and amounts caught by clause 3(c), remain payable.

任何一方均可书面终止委托。已产生的佣金及第三条（c）款所涵盖的款项仍应支付。

This agreement is governed by the laws of Victoria, Australia.

本协议受澳大利亚维多利亚州法律管辖。
